Wal-Mart Sucks for Providing Health Insurance and Maurice Graham Attorney at Law is an Asshole

JACKSON, Missouri (CNN) — Debbie Shank breaks down in tears every time she’s told that her 18-year-old son, Jeremy, was killed in Iraq.

Even though the 52-year-old mother of three attended her son’s funeral — she continues to ask how he’s doing. When her family reminds her that he’s dead — she weeps as if hearing the news for the first time.

Shank suffered severe brain damage after a traffic accident nearly eight years ago that robbed her of much of her short-term memory and left her in a wheelchair and living in a nursing home.

It was the beginning of a series of battles — both personal and legal — that loomed for Shank and her family. One of their biggest was with Wal-Mart’s health plan.

Eight years ago, Shank was stocking shelves for the retail giant and signed up for Wal-Mart’s health and benefits plan.

Two years after the accident, Shank and her husband, Jim, were awarded about $1 million in a lawsuit against the trucking company involved in the crash. After legal fees were paid, $417,000 was placed in a trust to pay for Debbie Shank’s long-term care.

Wal-Mart had paid out about $470,000 for Shank’s medical expenses, but in 2005, Wal-Mart’s health plan sued the Shanks for the same amount.

The Shanks didn’t notice in the fine print of Wal-Mart’s health plan policy that the company has the right to recoup medical expenses if an employee collects damages in a lawsuit.

The family’s attorney, Maurice Graham, said he informed Wal-Mart about the settlement and believed the Shanks would be allowed to keep the money. Video Watch this couple’s story »

“We assumed after three years, they [Wal-Mart] had made a decision to let Debbie Shank use this money for what it was intended to,” Graham said.

The Shanks lost their suit to Wal-Mart. Last summer, the couple appealed the ruling — but also lost it. One week later, their son was killed in Iraq.

“They are quite within their rights. But I just wonder if they need it that bad,” Jim Shank said.

In 2007, the retail giant reported net sales in the third quarter of $90 billion.

Legal or not, CNN asked Wal-Mart why the company pursued the money.

Wal-Mart spokesman John Simley, who called Debbie Shank’s case “unbelievably sad,” replied in a statement: “Wal-Mart’s plan is bound by very specific rules. … We wish it could be more flexible in Mrs. Shank’s case since her circumstances are clearly extraordinary, but this is done out of fairness to all associates who contribute to, and benefit from, the plan.”

Jim Shank said he believes Wal-Mart should make an exception.

“My idea of a win-win is — you keep the paperwork that says you won and let us keep the money so I can take care of my wife,” he said.

The family’s situation is so dire that last year Jim Shank divorced Debbie, so she could receive more money from Medicaid.

Jim Shank, 54, is recovering from prostate cancer, works two jobs and struggles to pay the bills. He’s afraid he won’t be able to send their youngest son to college and pay for his and Debbie’s care.

“Who needs the money more? A disabled lady in a wheelchair with no future, whatsoever, or does Wal-Mart need $90 billion, plus $200,000?” he asked.

The family’s attorney agrees.

“The recovery that Debbie Shank made was recovery for future lost earnings, for her pain and suffering,” Graham said.

“She’ll never be able to work again. Never have a relationship with her husband or children again. The damage she recovered was for much more than just medical expenses.”

Graham said he believes Wal-Mart should be entitled to only about $100,000. Right now, about $277,000 remains in the trust — far short of the $470,000 Wal-Mart wants back.

Refusing to give up the fight, the Shanks appealed to the U.S. Supreme Court. But just last week, the high court said it would not hear the case.

Graham said the Shanks have exhausted all their resources and there’s nothing more they can do but go on with their lives.

Jim Shank said he’s disappointed with the Supreme Court’s decision not to hear the case — not for the sake of his family — but for those who might face similar circumstances.

For now, he said the family will figure out a way to get by and “do the best we can for Debbie.”

“Luckily, she’s oblivious to everything,” he said. “We don’t tell her
what’s going on because it will just upset her.”

They need to sue their attorney for malpractice. He should have been aware of the provision in his clients health insurance contract and sought a higher settlement. More information about this case that CNN left out (it doesn’t make Wal-Mart look evil) is the fact that the attorney settled for the exact amount the trucking company was insured for. He brokered an easy settlement and got a big payoff and now he’s trying to shrug off his lack of fiduciary duty to his client by claiming he didn’t think Wal-Mart would go after the money it is contractually obligated to. He’s either an idiot or a schemer.

I suppose it doesn’t really matter though, why focus on just another bloodsucking lawyer when his incompetence borough forth another golden opportunity to bash Wal-Mart?

UPDATE:

Wal-Mart has bent to the pressure of ignorant people and has decided to drop their claim for the money to which they are contractually obligated. This sets a wonderful precedence where you can run someone down, ruin their life, only pay out what your insurance covers and expect someone else to cover the rest. If any of you are wondering why so many Americans don’t have health insurance here’s your answer. Thank the hippies and thank the bumbling Mr. Graham.

Citigroup Lost Nearly 10 Billion Dollars

Perhaps the cost of sending out daily, perpetually ignored, credit card offers to me and millions of others is significant after all. The cost of the paper, postage, printing and manpower to stuff each envelope probably costs about 50 cents. If we multiply that by a reasonable estimate of 40 million unfortunate recipients they’re looking at 20 million dollars every time they send out a mass mailing. Considering the fact I receive at least two offers from them every week and they are probably just as persistent with all of the other lost causes, that’s more than 1 billion dollars pumped into a black hole every year. While that figure doesn’t account for the entire amount of the loss it’s certainly indicative of the kind of the spotty management and sheer stupidity required to get the rest of it.

Citigroup, heres a tip, if someone doesn’t respond to one of your credit card offers, placing another one in their hands three days later probably isn’t going to sway them. In fact that kind of behavior will probably just motivate your targeted consumers to rub their hands together and laugh maniacally as they make smart ass blog posts about imminent misfortune.

Penis (Because it Draws the Traffic)

I was just looking through the spam folder of my gmail account when I noticed that I receive at least two solicitations for penis enlarging drugs every day. I know that these solicitations are a sham and I am sure many others do as well but it doesn’t take my much logic to figure out that a lot of people must be buying these things or else the spammers just wouldn’t bother. Why would one push a pill nobody is dumb enough to buy when you could sell porn, something everyone enjoys and purchases?

All of the effort that goes into selling appendage amplification placebos indicates that someone is profiting off of them which means someone is buying them. I cannot even begin to fathom the type of individual who would fall for this scam. At least that was until I came across this blog, http://www.whitemaleconsumer.com/. Obviously we are dealing with some very pathetic individuals here but in the interest of clearing out my spam I must make the statement “Guys, if you believe a pill you bought on the internet will make your penis grow, then it probably isn’t your dinky equipment that is keeping the girls away.

Today some scrawny little shit bucket murdered a bunch of people who were doing some Christmas shopping. This kid looks like your standard everyday dumbass who makes himself a constant target. Looking at a picture of this guy I see a skinny 19 year old wearing emo glasses and a haircut that would make an 80s rocker point and laugh. Let’s not even mention the attempt at facial hair. It is beyond me how this guy could get up look in the mirror and not piece together what it was about him that made his life suck. So instead of getting a haircut and not acting like a douche he instead loaded a weapon and went off to happily murder people who could figure out how to function in society. In fact he was so excited about his complete failure at life that he even wrote a note about going out in style as reported on CNN.

Now this rant may make it sound like I am just angry at those who voluntarily go against society’s norms then throw violent little temper tantrums when society unsurprising rejects them. I am definitely bothered by that but what really upsets me is the fact that I know so much about Little Miss Prove My Manhood by Shooting Up a Shopping Mall then Shoot Myself Like a Bitch Instead of at Least Having the Fortitude to Make a Stand when People with Guns Show Up. Why is it that the first I see when I visit CNN.com is that loser’s pathetic mug. He wanted to go out in style and I ask you, what’s more stylish than having your face shown to millions, if not billions, of people worldwide with a caption claiming that you did something to warrant attention?

People (douche bags) claim that violent video games or TV are to blame for the near epidemic of mass shootings we’ve seen by young people in recent years but I would submit perhaps the media is to blame. Most of these shooters are introverted little freaks who have been told by society that they don’t matter and nobody will ever see them as significant. Then they go and murder somebody and suddenly they’re more popular than news about Paris Hilton being butt fucked by the corpse of John Lennon. What the fuck people? These kids are learning that mass murder is the quickest way for an ugly anime fan to become a celebrity. Couldn’t we just refer to them as the gunman or faggy little murder fairy? There is no need to constantly state their names and certainly no reason their pictures must spend a week as the most viewed image in the world. If news outlets must use a picture how about an innocent victim as opposed to a murdering waste of flesh?

What I’m basically saying here is it seems pretty obvious to me that the biggest contributor in our society to mass murder by small dick teens is the media’s obsession with the shooters. Every time pundits focus on the shooter and try to attribute his actions to video games or the availability guns as the cause of his actions they are giving attention starved emos more motivation to murder than any amount of Halo would ever do.

Ho my God!!! He said “Nappy!”

Recently some guy who I had never heard of called some women’s basketball team I didn’t know existed “nappy headed hos.” I kind of wish I could have gone on being ignorant of this but for some reason I can’t quite fathom it has been the top running story on CNN’s website for the last week. Apparently it is racist or something to call people nappy headed hos… now we know.

Normally I would ignore this, despite the fact it’s impossible to do given the story’s level of saturation, if not for a recent story I read when one of the young ladies from the basketball team, or ho if you prefer, came out and started bitching about how this whole thing has detracted from their celebration for emerging victorious in some thing or another. My only thought after reading this was, are they not the one’s who raised such a fuss to cause this “controversy” to overshadow their achievement.

The only thing I know about Don Imus is that he is kind of like Howard Stern, the only reason I know this is because of the fact that he is so obscure every news story on the subject must include the description, “similar to Howard Stern” so readers know what the hell the story is talking about. So thinking logically, if this guy is similar to Howard Stern, but less known and Howard Stern is locked into a premium radio service that only 100 or so people listen to, Don Imus’s audience must be about 6 people. I wonder if any of the women on the basketball team are one of these 6 people or if one of the 6 just happened to know someone on the basketball team and told them to be offended.

The fact is if this guy is obscure in comparison to a guy no one listens to then someone would have had to do a lot of blowing out of proportion to make some comment he said the top running story for a fucking week. I’m not trying to excuse what he said, I’m sure it was racist or not gender sensitive or something but come on. If some obscure redneck whom you at best have a passing name recognition to says something mean about you and you put on a cry and bitch parade for the whole country to see claiming it’s the most important thing going on in the world right now, at least that’s what I assume the claim is given the level of news coverage which encompasses all important things happening in the world and this comes out on top, don’t be surprised if it overshadows anything else you’ve done.

Here’s a thought what if when someone told these girl’s that some “known” dick head said something not nice they just shrugged and said wow what an ignorant prick, I hope he burns in hell. Then they could have moved on with their lives with class and dignity instead of being the basketball bitches leading the lynch mob against that racist guy, you know the one who’s kinda like Howard Stern only not well known.

Desiree Mangum (1988-2006)

As I grew up I was fortunate enough to share a large part of my childhood with a family of the kindest most decent individuals one could ever hope to encounter. Among them was a girl whom I fought with, laughed with and cared for as deeply as if she were my own sister. Desiree was strong, confident and had the ability to posses and spread joy as easily as she could breathe. Ever content with herself she also had no hesitation in rising to the defense of others. To have known Desiree is to know honor for there is no doubt that she, as only one of her conviction and morality can do, shall stride boldly through the gates of heaven into the arms of the Lord knowing that she is worthy and loved.

Hippie Cars

Some people like to spend a lot of money on expensive tires, wheels and exhaust systems to make their cars look nice, hippies have a different approach. How do they deck out their Toyota Priuses and 60’s Volkswagens with leaky exhaust that probably put out ten times more pollutants than any F-350? With classy bumper stickers of course, because they are indeed classy folks. Yes indeed, nothing is cooler than sporting a John Kerry bumpers sticker a year after his defeat.

I do have a point for bringing this up, although I don’t think I really need a reason to insult these people. Last night in traffic I was behind a Nissan Sentra with a nice collage of stickers and I noticed one that read “I’m pro-choice and I vote.” Good for you, I thought, too bad the pro lifers appear to be voting in higher numbers these days. Then another sticker caught my eye not three feet from the smug celebration of slaughter. This one read “Save a life, adopt a pet from the local animal shelter.”

A bit of hypocrisy perhaps, or does this person truly place a greater value on some inconsequential cat or dog than the life of a human child? Whatever the justification it is so comforting to know I am up against such high degree of rationality.

Tina Marie Stebbins revealed her intentions in a letter released Monday as her boyfriend, Christian Leroy Lindblad, 37, was sentenced to 20 years in prison for shooting her in June 2002.

“I love Christian today as deeply as I loved him before this awful thing happened to us,” Stebbins wrote in a victim impact statement. “We are soul mates.”

She added: “I want to tell you all that I have forgiven Christian. And I pray that Christian has forgiven me for failing him when he needed me most.”

PARIS, France (Reuters) — France’s parliament is expected to approve a government plan to extend emergency powers for three months to quell unrest which President Jacques Chirac said pointed to a deep national malaise.

In a fresh sign that violence is on the wane, police said on Tuesday 215 vehicles were destroyed overnight in the 19th straight night of trouble, against 284 the previous day. In only 7 of France’s 36,000 municipal districts were more than five cars destroyed.

The center-right government has decided to seek the extension of the measures, such as curfews, to help stamp out violent protests against racism and unemployment by youths of African and Arab origin as well as white youngsters.

“We will respond (to the violence) by being firm, by being fair and by being faithful to the values of France,” Chirac said in a television and radio speech, his first direct address to the nation since the unrest began on October 27.

“These events bear witness to a deep malaise,” he said. “It is … an identity crisis.”

We Don’t Stand a Chance

There are about 78 million people in the baby boomer generation and they are going to start retiring in the next decade. Now as I’m sure everyone is aware of yet blissfully ignoring the social security system doesn’t have any money it. The system works right now because there are enough people paying into it at the moment to cover the people drawing from it. After the baby boomers start retiring though that will no longer be the case.

Between Generations X and Y there are roughly one hundred million people. Of course as most people know we can pretty much disregard a good percentage of Generation X is incompetent dead beats who are living in their baby boom parent’s basements. Comforting isn’t it? The question is can 100 million people support 78 million at the current social security rates? The answer is a resounding hell no.

You may ask how we got into this predicament, after all doesn’t the money we see extracted from every single one of our meager teenage or college student paychecks go into a big fund to accumulate interest and cover our retirement? Nope, apparently Franky Roosevelt thought congress would just ignore that big pot of money just sitting there so nobody bothered to put in place any protections for it. So the money you put in goes to pay for a missile, some roads or maybe some welfare checks for heroine addicts. This means the baby boomers who are currently paying into the social security system are seeing their money pay for all this stuff while they get to enjoy relatively low tax rates. (We won’t go into how a lot of that shit can be cut). The problem is the baby boomers are going to want to see that money given back to them when they retire. So where is it going to come from? You and me… unless you’re one of those Generation X deadbeats.

Since there are going to be so many retirees not only will they have to raise the social security rate to cover all of their checks but they will also have to raise the general tax rate to fund all the stuff social security money was being used for. (Once again bullshit cuts could come into play here but it’s the federal government so we’ll be realistic). Now you may be thinking “we’ll just cut those old farts benefits.” Wrong. If the historical rates hold true the baby boomers will out vote the younger generations in every single election meaning that their benefits will most likely be increased.

So where does this leave us? Very poor, probably without enough money to invest for our own retirements. We would have a very slim chance of fixing this problem but we would have to do it right now before the baby boomers retire and start sucking on the great socialist tit. Unfortunately only one politician has been brave enough to even bring the issue up and he was relentlessly attacked by both sides of aisle.

If you don’t like private accounts that’s fine but let’s not kill the issue completely just to hurt a man who will have been out of office for several years when we start feeling the effects of ignoring him. This isn’t a right or left issue this is about our generation doing what we can to protect our futures.

Customer Service

In most service positions it is fairly common for miscommunications to occur or for someone to just simply fuck up. When you find that order is wrong or incomplete or perhaps you were overcharged do you go up to the employees, whether they’re responsible or not and start yelling and lecturing them? In most situations people understand that they made a mistake and are more than willing to fix them once they are made aware. However, for some reason somebody who felt they were wronged can never see eagerness to resolve a situation and take offense and fight over every question they may be asked. Usually the person is just trying to find out exactly what the problem is and the best way to fix it. I know of very few places that will tell a customer “too bad, so fuck off” if the customer has a legitimate complaint.

I can almost guarantee that you’ve made a mistake at your job once or twice that irritated somebody so why not give other people a little slack. First approach them calmly and state your problem, if they are willing to help you then go along. Don’t just come up and start yelling that simply causes confusion for the bewildered person who has to deal with you. If they are unwilling to work with you then go ahead and get angry and make a scene but only after you’ve acted like a civilized member of society.

A Parent’s Dilemma

Although I am still a couple of years from children I have recently been struggling with a question that will more than likely become a defining issue for my generation. In which order should parents introduce the Star Wars movies to their children. There is of course the obvious numerical order, which would tell the entire story from start to finish but recently I have wondered if children would miss out on something important by not watching them in the historical order starting with episode IV.

I am referring of course to the scene in the Empire strikes back when Darth Vader says the immortal words “Luke, I am your father.” I still remember the first time I watched that seen and the utter shock I was struck with at such an intriguing prospect. Of course if a child where to have seen episodes I-III before they saw that seen then the only thought they would take away from that scene is “Duh.” I wonder if the range of thoughts about and surprise from Vader’s revelation would be worth starting my children on episode four and breaking ignoring the opportunity for a smooth story arc. Also it would be nice for them to watch episodes IV and V at least once without having to think about how fucked up the kissing scenes are.

I was minding my own business selling hamburgers to fat fucks that enjoy greasy food when this smelly ass hippie came in. In the proper hippie fashion he had ridden his bike to the restaurant so as to be one with nature. Or maybe he just can’t afford a car being that I’m pretty sure he doesn’t have a job. I may be wrong but I don’t think there are many openings for 50-year-old men with nappy, moldy unwashed hair down past their shoulders.

So the son of a bitch orders a regular old hamburger, they cost 74 cents or something I don’t know I have a job so I can afford something with cheese. So I get his little hamburger and put it in a back with some napkins and hoped to get that odor out of range of my nose. He started to walk away then suddenly turned around and asked me “have you seen the movie ‘Super Size Me.’“ Well I like to be entertained when I spend money on movies so of course I hadn’t seen it. If you are spending that much money to learn something or for some kind of artistic experience you don’t really enjoy then you are just idiot. Anyways I told him I hadn’t seen it and he suggested I should. Jokingly I said “nah, that’s just negative propaganda,” to which he responded, “is it propaganda?” Well that’s quite the little battle of wits that 50 year old was setting up with 19 year old McDonalds employee, unfortunately one of my managers took over. So here’s the answer decorum wouldn’t allow me present.

Of course it’s propaganda you stupid fucking son a bitch (that part would have probably gotten me into trouble). The very idea that McDonalds is making you eat fatty food is insane. What exactly are they doing? It is a well-known fact that food that isn’t good for you tastes better than food that is. Why else would we give boxes of chocolates rather than boxes of Brussels sprouts? Why this is I don’t know, I assume God is just kind of a jackass. So even though there are thousands of healthy alternatives out there people would still like to eat deep-fried send you to an early grave types of food. McDonalds being a capitalist corporation (dirty word for hippies) realized this fact so they decided to take advantage of the fact that people would pay money for these kinds of unhealthy food. McDonalds didn’t give people this want they simply realized it was already there. The reality is people don’t want healthy food they want to bad stuff, if this were false McDonalds would offer salads (McDonalds does offer salads but they don’t sell for shit. And the people who do order them add fries and soft drinks, what’s up with that?).

Basically what I’m saying is if you have an incredibly fat ass because you ate fast food five square meals a day it isn’t McDonald’s fault. It just means that you are a pathetic individual who should continue eating two double quarter pounders at a time so you can remove yourself from the gene pool as quickly as possible. If it doesn’t kill you it will at least have a negative enough effect on your personal appearance that nobody will mate with you. Once the natural selection process of McDonalds works it’s magic and all of the bike riding hippies get run over by SUVs then perhaps we can live in a world where people take responsibility for their own actions rather than pointing their enormously plump or their scrawny malnourished vegan dieted fingers at whoever happens to see profit in human nature.
